March 25, 2014 - Recently, in an article dated March 19, 2014 published in the Suburban Newspaper entitled “City Attorney at Center of Investigation”, the City of Seagoville was named on several different occasions. The City Council, excluding Mayor Harold R. Magill in all areas except where specifically stated, would like to publicly address some of the statements made in said article.

Beginning with the first sentence in the article, the Suburban states that “…the Texas Rangers investigating allegations of embezzlement at Seagoville City Hall.” This is an untrue statement, the allegations are made against the former Seagoville Economic Development Corporation President/CEO and that is the individual being investigated by the Texas Rangers. The Seagoville Economic Development Corporation is a separate entity from the City of Seagoville and the offices are on opposite side of town.

The article goes on to state that “Until March 10, 2014 the audit was kept quiet even though it had been issued on October 31, 2013” and it even addresses the redactions contained therein. The truth is, the audit was made public at the February 10, 2014 Seagoville Economic Development Corporation meeting and the redactions in the audit are pursuant to State law, specifically the Texas Public Information Act. We would note that the audit was not released earlier so as not to interfere in any way with the criminal investigation, not to cover-up any portion of the audit or its findings.

With regard to the portion of the article wherein Mayor Harold Magill is allegedly quoted, the Seagoville City Council members publicly state that Mayor Harold R. Magill was not authorized to make public statements for or on behalf of the governing body nor does the Home Rule Charter give him authority to do so as Mayor. Any statement that Mayor Magill may have made to the Suburban concerning the City Attorney and/or the City Manager are solely his personal comments and/or statements NOT that of the City Council. The Seagoville City Council members fully support City Attorney Bob Hager and the City Manager without reservation.

Further, upon learning of the release of the referenced article, Mayor Harold Magill sent an email to the City Secretary for forwarding to the City Council members stating in relevant part, “. . . earlier I expressed to you in no way did I give an interview or authorize an interview with the Duncanville Suburban Paper. The mayor of Duncanville a Mrs. Hodge called me and was telling me about their issues. . . . I have a call into Bob requesting he call me, I am contacting an attorney in the morning and demand a full retraction and a apology to Bob and myself. At no time was I informed Mrs. Hodge was interviewing me. She continued to express her issue which I have no interest in.”

On or about March 14, 2014, the City Council members provided written notice to Mayor Magill to cease and desist making public comments to the media and/or individuals without specifically stating the statement or opinions expressed are his personal comments rather than as Mayor. Further, the City Council specifically informed Mayor Magill in writing that the Council does not consent nor authorize him [Mayor Magill] to speak for them individually, nor as a council on behalf of the City of Seagoville.

Again, the Seagoville City Council members publicly state that the City Attorney has always provided us with a full disclosure of the facts in this matter, there has not been any cover-up, no one has retaliated against any other individual that we are aware of, and City Attorney Bob Hager has the full support of the City Council.
